Digital assets (also referred to as “files” or “recordings”):  any and all audio and/or video recordings.

Registration Terms & Conditions:

Kim Dumaine offers this collection of digital assets for download and use at your own risk. You are solely responsible for the consequences of any use you choose to make of the assets you download from this collection.

You may keep one copy of each file for back up purposes.

Each file may be shared with one person other than the original purchaser.

The files may not be uploaded, posted, or transferred to any site, service, or made public, or otherwise distributed in any way, in whole or in part.

The asset may not be transcribed and shared or distributed in any way in whole or in part.

Provided you keep intact all copyright and other proprietary notices and attribute the source as Kim Dumaine, you may use audio or text quotes not exceeding three sentences from the assets for appropriate professional purposes.

You agree not to use the information and materials in the files in any way that is knowingly false, defamatory, inaccurate, abusive, vulgar, harassing ,obscene, profane, threatening, invasive of a person’s privacy, or otherwise in violation of any law.

The files are the sole property of Kim Dumaine and are provided ‘as is’ without warranty of any kind, whether express or implied. No changes of any kind may be made to the content of the files. All implied warranties, including, without limitation, implied warranties of merchantability, fitness for a particular purpose, and non- infringement, are hereby expressly disclaimed. Images downloaded are for the sole intended use of advertising or promoting

Kim Dumaine retains all rights and the recordings may not be used for any other express purpose.

Specific

“This End User License Agreement is a legal agreement between you (in your capacity as an individual and as an agent for your company, institution or other entity) (collectively, “you” or “Licensee”) and Kim Dumaine. Downloading, displaying, using, or copying of an recording by you or by a third party on your behalf indicates your agreement to be bound by the terms and conditions of the License Agreement. You agree that the recording selected by you may be used for noncommercial, educational purposes only; no derivative works are allowed, and attribution and copyright notice is required. Any transfer of the recording by you must be for non-commercial purposes: transferred copies are equally subject to the terms of this Agreement. Please provide the following copyright notice on any appearance of a downloaded image: ©Kim Dumaine. If you do not agree to these terms and conditions, do not download, display or use the image.”
